The government and the culture of easiness

If we go back to our government records, we would discover that they are full of failures at all levels. I will point only at two issues. The government is seeking to stiffen the detention punishment, as we read, few days ago, about the government's desire to amend the period of remand. It seems that the intention is to expand the sanctions system. The government proposes to return to the previous situation, when the term of imprisonment was 21 days instead of ten days at the moment. This amendment was approved by the nation’s council. Investigators had the right to detain the accused for four days at the police station instead of two days now. This is happening in Kuwait despite the attempts of the neighboring countries to expand freedom’s margins and trying to cope with the Arab Spring and all its implications, however, many people in Kuwait wish to face the storm.

The government is trying to dedicate a type of recidivism and seeking to curtail freedoms. This is a precedent in a country proud of having wide freedom margins and commitment to the constitution. It is part of a facilitating culture that began to invade us strongly after the liberation. You can put thousands of laws in a record time, but you can adapt people to it? Laws are created to organize life and make it easier. Jurists did not think of controlling and petrifying people’s freedom. But what is wisdom hidden behind toughening penalties? Some people give flimsy justification to pass the amendment. The Ministry of Interior is complaining. They say that some disadvantages arose from the application of the old law. But, is there any way out? The problem, gentlemen, resides in the application of the law. The new law lifts the injustice off thousands of people, made the procedures easier and has limited the investigators and prosecutors authority margins while keeping off the hands of bad intention people to manipulate the fate of people.

In the past, the process was subject to some people’s mood and injustice affected many people for this reason. Today, we are seeking more freedom so we do not have to be blinded of truth, because it is clear. We realize that the world is changing and we know that the birds do not fly without wings, as well as is the case for people with freedom. They want more freedom and there are many people mistaking in applying the laws. Solutions are numerous and its creators are numerous too. So, open the windows before the breeze of freedom. We have a lot of blooming brains; let them be opened to the future and its challenges though there is a solution or each problem. Kuwait is awaiting someone who can save it from the abyss without ignoring the problems and leaving things worse. We badly need to overcome the mentality of the past and to look forward to a bright tomorrow. Challenges are great but the brains are bigger.

On the other side, the observer is surprised with the kind of selectivity in the implementation of judicial decisions. This happens in Kuwait publicly. Everyone shut up about that, despite its clarity. The constitution did not differentiate between citizens in Kuwait in anything. All citizens are equal before the law, have the same rights and they have the same duties; and the issue is very clear. We saw what happened recently in the case of some members of the rescind council. They are accused of the defect of being princes. The court sentenced three of them to three years of imprison with labor force but the authority did not take the initiative to the execution of the judgment and left them free. An appeal was presented to the court, but none of the accused and condemned appeared before the court.

Here, we wonder if it is an incomprehensible mystery. Is it a play while the truth is not? The judge has the right to imprison the condemned and then he can appeal. But this did not happen with the three above mentioned condemned. And here comes to mind more than one question: Is it some kind of a deal? Why does the authority behave in a different way with of ordinary people in a similar situation?
